This FORM is owned and operated by Neighborlender, LLC, an Idaho limited liability company with its corporate headquarters in Rexburg Idaho. Neighborlender is a social network lending service. Neighborlender does not make loans or credit decisions. By using this FORM, you are agreeing to comply with and be bound by the following terms of use. Please review the following terms carefully. If you do not agree to these terms, you should not use this FORM. The term "us" or "we" or "our" refers to Neighborlender LLC, the owner of this FORM. The term "you" refers to the user or viewer of our FORM. The term "lender" refers to anyone purchasing a loan or lending to a Borrower. A lender is a creditor. The term "Borrower", refers to the person requesting a loan or listing their request. A borrower is a debtor. The term "donations" refers to monies given with no obligations or restrictions to the person requesting same. "Paypal" is a third party company used to submit and return payment, we are not in any way affiliated with paypal aside from using their services and as such are subjected to their rules and regulations. By using the FORM, you signify you understand and agree to be bound by the terms and conditions of this Agreement. If you do not agree to this, DO NOT USE THIS FORM. This Agreement is subject to periodic change at our sole discretion. As such, each user of the FORM agrees to review this Agreement periodically in the section of the FORM entitled "Terms of use"
Acceptance of Agreement
You agree to the terms and conditions outlined in this Terms of Use Agreement ("Agreement") with respect to our FORM. Neighborlender is not an agent of either you, the consumer, any lender, or any other company. Neighborlenders services are to list loan request, donation request and try to ensure lenders receive payments in their entirety, list donations for third parties and collect and remit monies from third parties. You should rely on your own judgment in deciding to use Neighborlenders loan request system. You are under no obligation to use Neighborlender to commence with your loan request form, and Neighborlender does not guarantee that completing a loan request form will result in your receiving your requested loan. Your request is NOT an application for credit. Neighborlender does not charge the lender, any fees for its services. Neighborlender may receive a fee from borrowers for late payments over five business days over the due date. The amount of the late charge will be one hundred dollars and no cents, fifty dollars of which will be remitted to the lender issuing the loan. The lender issueing the loan will be repaid the sum of monies issued plus 10% of the balance at time of issue. Neighborlender will be paid 15% of the sum of monies issued by the lender at the time the borrower repays. The amount the borrower repays will be the amount issued plus 25%. All percentages reflect a non-compounding interest and are unfluctuating in amount or frequency. We will perform the following services for you: (1) make loan request forms available to you; (2) transmit your loan request form to an open source forum for public view and or purchase; (3) offer you access to general educational information concerning alternate loan companies and resources. If you do not fill out the complete loan request form on our FORM, or leave portions of the form incomplete, Neighborlender will not list your loan request form to the public. You understand that Neighborlender may keep your loan request form even though that may not provide you the loan requested. Neighborlender does not endorse or recommend the service or products of any Partner. You agree that Neighborlender shall not be liable for any damages or costs of any type arising out of or in any way connected with your use of such services or our Loan Request Form. Neighborlender does not guarantee acceptance on any loan request. Likewise, Neighborlender does not guarantee that your request will be made available. By entering any information on our FORM, you are extending an express invitation to receive an offer, and any and all offers in the future via mail, telephone, email, or any other delivery method deemed appropriate by the offering party, regarding your request, or any other type of service deemed appropriate by us or our advertising partners, by contacting you at the telephone numbers or email you have provided on your Service Request Marketing Form.We do not receive any portion or percentage of donations given to parties requesting them, however we do send monies to the requestor using Paypal and Paypal usually charges the person or persons receiving money a percentage. You may not request more than one loan at a time. You may not request an additional loan while any amount is due from a previous loan through Neighborlender LLC.
Indemnification
You agree to indemnify, defend and hold us and our partners, agents, officers, directors, employees, subcontractors, successors, assigns, third party suppliers of information and documents, attorneys, advertisers, product and service providers, and affiliates (collectively, "Affiliated Parties") harmless from any liability, loss, claim and expense, including reasonable attorney's fees,
A feedback report will be given by your lender and will be attached to your loan request and any future loan request with us. We are not responsable for any damages caused by any such report and the borrower may not hold the lender liable for any negative reports issued. To contest a report you may contact us and we will forward the information to the lender.
USE OF THE FORM IS AT YOUR SOLE RISK AND IS WITHOUT WARRANTIES OF ANY KIND BY US, EXPRESSED, IMPLIED OR OTHERWISE, INCLUDING WARRANTIES OF TITLE, FITNESS FOR PURPOSE, MERCHANTABILITY OR NON-INFRINGEMENT. If you remove your information from our database it will no longer be used by us for secondary purposes, disclosed to third parties, or used by us or third parties to send promotional correspondence to you.
